With the advent of new communication tools, it is necessary to pay particular attention to the protection of privacy. That is why we, “Immocalcul Inc. (hereinafter “Immocalcul Inc.“), are seriously concerned about the privacy of your personal information and we are committed to respecting the information we collect.

Immocalcul Inc. undertakes to respect, in accordance with applicable laws, the obligations regarding the collection and processing of personal and confidential information obtained in the context of the operation of a company so that everyone can benefit from the respect of their private life.

The present privacy policy (hereinafter the “Policy”) describes the information that Immocalcul Inc. may collect from the user, that is to say the end user or the organisation you represent or you work for (hereinafter the “User” or “Users”), in connection with its activities, the purposes for which Immocalcul Inc. collects it, the use it makes of it, and the circumstances under which it can pass them on to third parties. In addition, this Policy indicates the User’s rights regarding the collection, use and communication of its personal information. Immocalcul Inc. agrees not to collect, use or disclose the User’s personal information otherwise than in accordance with this Policy and applicable laws in Canada and Quebec.

Immocalcul Inc. s’engage à ne pas recueillir, utiliser ou communiquer les renseignements personnels de l’Utilisateur autrement qu’en conformité avec la présente Politique et les lois applicables au Canada et au Québec.

SCOPE OF THIS POLICY

When the User browses Immocalcul Inc.’s website and mobile application (hereinafter the “Platform”) he agrees to the terms and conditions of this Policy. If the User continues to use the Platform after a new version of this Policy has been posted there, he consents to and will be bound by the changes.

The information Immocalcul Inc. collect is necessary when Immocalcul Inc. provide the User with a service that he has requested. By providing Immocalcul Inc. with this information, the User consents to its collection and use as defined in this Policy.

COLLECTION OF PERSONAL INFORMATION

Immocalcul Inc. may obtain personal information from the User when the User saves this personal information on the Platform, or where appropriate, when the User discloses this personal information otherwise, such as creating a User account and choosing a password, by logging in as a registered User to the Platform, by launching a product search, by requesting a service, by providing information on his account, by contacting us by phone, email or otherwise, or by completing a form to enter a contest, inventory request, promotion or survey.

We collect the following User information, upon registration:

  • Surname and first name;
  • Age;
  • Gender;
  • Telephone number;
  • Personal address;
  • Email address; and
  • User's position, personal budget information, browsing habits in the app and the website.

The User’s personal information will not be retained beyond the purposes for which it was collected. The deletion of the data occurs once the User deletes his account. The User will then have thirty (30) days to recover his data, otherwise, Immocalcul Inc. will delete them permanently.

The Platform is designed for use by adults only, as understood in the Province of Quebec. Immocalcul Inc. does not knowingly collect any personal information from anyone under the age of eighteen (18).

For more information on the protection of the User’s personal information and his related rights, the User may contact the Office of the Privacy Commissioner of Canada or the Commission for the Protection of Privacy of Quebec.

FORMS AND INTERACTIONS

The User’s personal information may be collected through forms, namely:

  • Registration on the Platform Form;
  • Order Form;
  • Survey;
  • Update the User's profile Form;
  • Resources download Form;
  • Contact importation Form;
  • Authorization of the User to access his information;
  • Contact Form;
  • Assistance Form;
  • Ad submission Form;
  • Community discussion Form;
  • Contest; and from the mobile application

Immocalcul Inc. uses cookies, as indicated in the “Automatically Exchanged Data” section. Immocalcul Inc. may also keep a record of the User’s product interests and obtain his information from divisions or current or future companies belonging to Immocalcul Inc..

Immocalcul Inc. may use the User’s personal information in order to:

Identify the User; To process the User's requests and orders and to answer his questions; To communicate with the User (by e-mail, mail or otherwise) and to send the User promotional materials or additional information about products, services, surveys, contests, promotions and special offers; To learn more about the User's purchasing preferences; To develop new products and services; Conduct market research and performance research to evaluate customer service, measure performance, enhance the User experience and improve products;

If the User has not subscribed to Immocalcul Inc.’s newsletter, he will not receive any emails from Immocalcul Inc., except in special cases (i.e. follow-up or expiry of its subscription, follow-up of its free trial, participation in a contest, etc.).

The User’s information is also collected through the interaction that may be established between the User and the Platform and may be used for the following purposes:

  • To understand the use of the Platform by the User
  • To Improve the Platform;
  • To manage customers’ accounts.;
  • To share with the Enterprise's partners;
  • To share to third party applications websites or integrations on/or using our products.
  • To observe regulatory compliance laws and regulations; and
  • To send promotions.

ADVERTISING INFORMATION

Immocalcul Inc. will contact the User only if he wishes. If the User prefers not to receive any advertising information from Immocalcul Inc. or if he does not want Immocalcul Inc. to use his personal information to enhance his customer experience, the User shall let notify Immocalcul inc. and reach out to the contact listed in the section “Right of opposition and withdrawal”.

User should remember his or her full name and email address used when registering or making a purchase from Immocalcul Inc. There may be a delay in processing an email or postal mail request and User may continue to receive communications from Immocalcul Inc. in the interim.

THIRD-PARTY SERVICES

Immocalcul Inc. may use third-party services for the management of its business and its Platform. In no event shall Immocalcul Inc. be held liable for any prejudice that may arise from such third-party services. Immocalcul Inc. invites the User to consult these services’ respective websites, in order to learn about their conditions of use.

Immocalcul Inc. prohibits and is not responsible for the resale or use by third parties of opt-ins obtained through the Platform by event organizers. If the User has agreed to share their contact information with partner organizations, then we will share it with them. We do not sell or rent our lists.

Elles ne sont recueillies qu’en raison d’exigences technologiques inhérentes à la navigation sur Internet. Par contre, si l’Utilisateur choisit de refuser les témoins, il ne pourra peut-être pas s’identifier, ni utiliser certaines fonctions de la Plateforme.

Ces informations servent également à : Identifier l'Utilisateur ; Traiter les demandes et les commandes de l'Utilisateur et répondre à ses questions ; Communiquer avec l'Utilisateur (par courriel, par la poste ou autrement) et lui faire parvenir du matériel publicitaire ou de l'information supplémentaire sur les produits, services, sondages, concours, promotions et offres spéciales ; En savoir plus sur les préférences d'achat de l'Utilisateur ; Développer de nouveaux produits et services ; et Effectuer des études de marché et des recherches sur le rendement afin d'évaluer le service à la clientèle, de mesurer le rendement, de rehausser l'expérience procurée à l'Utilisateur et améliorer les produits.

Ces fichiers témoins sont multiples, certains expirent lorsque l’Utilisateur ferme son navigateur et n’ont plus d’effet alors que d’autres peuvent être conservés. En tout temps, l’Utilisateur peut désactiver les témoins. Cependant dans cette situation, Immocalcul Inc. ne garantit pas un fonctionnement optimal de la Plateforme.

AUTOMATICALLY EXCHANGED DATA

Immocalcul Inc. collects certain information during exchanges between the User’s computer and Immocalcul Inc.’s server. Cookies allow the User to connect to the Platform.

This information consists mainly of the following:

  • Domain name;
  • IP address;
  • User's language; and;
  • Login to Immocalcul Inc. services.;

Most of the information transmitted automatically does not identify the User. It is collected only as a result of technological requirements inherent in Internet browsing. Most browsers automatically accept cookies, but it is usually possible to change this behavior. However, by choosing to decline cookies, the User may not be able to log in or use certain features of the Platform.

The use of such information allows Immocalcul Inc. to improve the service offered, to personalize the User’s experience and to better track his requests and orders.

This information is also used for:

  • Identify the User;
  • To process the User's requests and orders;
  • To answer the User’s questions;
  • To communicate with the User (by e-mail, mail or otherwise) and to send the User promotional materials or additional information about products, services, surveys, contests, promotions and special offers;
  • To learn more about the User's purchasing preferences;
  • To develop new products and services;
  • To conduct market research and performance research to evaluate customer service, measure performance, enhance the User experience and improve products;

These cookies are multiple, some expire when the User closes the browser and have no further effect while others may be retained. At any time, the User may disable cookies. However, in this case, Immocalcul Inc. does not guarantee an optimal functioning of the Platform.

INTERNATIONAL COMMUNICATIONS

It is possible that in certain situations, the User’s information is transferred to servers outside of Canada. In such cases, the servers are in the following regions: Canada, United States

The User acknowledges that Immocalcul Inc. is not liable for the consequences of such transfer.

Immocalcul Inc. peut, dans les cas suivants, communiquer exceptionnellement les renseignements personnels de l’Utilisateur sans son consentement :

  • En cas d’obligation légale, notamment lorsqu’une ordonnance d’un tribunal oblige Immocalcul Inc. à communiquer les renseignements personnels de l’Utilisateur.
  • Lorsqu’il est impossible d’obtenir le consentement de l’Utilisateur et que les lois sur la protection de la vie privée permettent à Immocalcul Inc. de communiquer ces renseignements personnels. C’est notamment le cas lorsque la protection de l’intérêt public l’exige.

SHARING PERSONAL INFORMATION

Immocalcul Inc. markets personal information collected from the User who provides express consent to do so - as defined below in the 'Anti-Spam Legislation’ section.

The situations in which personal information may be shared are the transmission of User contact information to a third-party Financial Products Provider or broker in connection with User requests for information, sharing with company partners, promotional offers, sharing with third party applications, websites or integrations on or using our products and law enforcement or legal requests. In the first case of sharing mentioned above, the Provider will contact the User directly about the details of the requested Financial Products

The User understands that Immocalcul Inc. may at any time share personal information in the event of a partial or total transfer of the business to a third party. In such event, the information transferred as an asset of Immocalcul Inc. will be subject to the same safeguards as this Policy.

If the User does not wish to have his or her personal information shared with third parties or partners, he or she may opt out at any time, as discussed in the next section.

Immocalcul Inc. may, in the following cases, exceptionally disclose the User's personal information without consent:

  • When required by law, such as when a court order requires Immocalcul Inc. to disclose the User's personal information.
  • When consent cannot be obtained, and privacy laws permit Immocalcul Inc. to disclose personal information. This is particularly the case when the protection of the public interest so requires.

WITHDRAWAL AND OPPOSITION RIGHTS

Immocalcul Inc. is committed to offering the User the right to oppose and withdraw his personal information.

The right of opposition is understood as the possibility offered to the Users to refuse allowing their personal information to be used for certain purposes mentioned regarding data collection.

The right of withdrawal is also understood as the possibility offered to the Users to request that their personal information no longer appears, for example, in a mailing list.

The User also has the right to request access to the personal information Immocalcul Inc. has collected about him and to correct any information as needed by contacting the contact person in charge of data management whose information is listed in the section “Contact person” below.

ANTI-SPAM LEGISLATION

Immocalcul Inc. complies with the dispositions of the Canada’s Anti-Spam legislation (CASL). The User understands that he or she may expressly or tacitly consent to receive messages from Immocalcul Inc..

Express consent is consent sought from the User, which consent shall be stated in plain language and shall include the purpose for which consent is sought, prescribed information identifying the person seeking consent and, if sought on behalf of another person, prescribed information identifying that person; and such other information as may be specified by regulations made under this Act.

The User understands that he gives his tacit consent during the existing business relationship or the existing non-business relationship; when the User publishes his e-mail address without mentioning that he does not wish to receive unsolicited commercial electronic messages; or when the message is sent in the other circumstances provided for by the regulations under this law.

  • For the purposes of this Policy, 'existing business relationship' refers to a business relationship between two persons, such as a purchase or lease within two years prior to the date the message is sent; an investment or game offered, the bartering of a thing, any contract in effect or expiring during that period, or a request within six months prior to the date the message is sent.
  • An 'existing non-business relationship' is defined as a relationship between two persons other than a business relationship, such as a gift or donation, work done as a volunteer, and a membership, as defined in the by-laws; all within the two years prior to the date the message is sent.

SECURITY

The personal information that Immocalcul Inc. collects is kept in a secure environment. Immocalcul Inc. has adopted appropriate measures to maintain the confidentiality of personal information and to protect it from loss or theft, as well as from unauthorized access, disclosure, copying, use or modification, taking into account, among other things, the sensitivity of the information and the purposes for which it is used. In addition, Immocalcul Inc. requires each employee, agent or representative of Immocalcul Inc. to comply with this Policy.

In order to ensure the security of the User’s personal information, Immocalcul Inc. uses the following measures:

  • SSL (Secure Sockets Layers) protocol;
  • Secured access to its premises;
  • Firewall;
  • Confidentiality agreements with its employees;
  • Privacy policies;
  • Procedures for the protection of personal information;
  • Use of password-protected data networks;
  • Current update of security measures; and
  • Canadian server.

Immocalcul Inc. is committed to maintaining a high degree of confidentiality by incorporating the latest technological innovations and thus ensure the confidentiality of the User’s transactions, in order to protect the User’s personal information and prevent it from being viewed, used or disclosed without authorization.

However, since no mechanism provides absolute security, some degree of risk is always present when communicating personal information over the Internet. If a password is used to protect the User’s account and his personal information, it is his responsibility to keep it confidential.

FRENCH AND ENGLISH LANGUAGE

If a problem of definition or interpretation arises between the English and French versions of this Policy, the French version shall prevail.

Nonobstant toute attribution de compétence et de droit applicable, lorsque l’Utilisateur est un consommateur au sens de la Loi sur la protection du consommateur du Québec, alors tout litige relatif à la présente Politique sera régi par le droit de la Province du Québec, et sera nécessairement porté devant une juridiction compétente en application des règles du Code de Procédure civile.

APPLICABLE LAWS AND JURISDICTION

The Platform and its content are managed by Immocalcul Inc. from their offices located in the province of Quebec in Canada. The Platform, its content, the Terms of Use and your use of the Platform are regulated by the applicable legislation of Quebec and Canada, without giving effect to any principle regarding conflicts of laws.

You accept that any question or litigation regarding the Platform and your use of it will first be brought before a mediator and, in the absence of a compromise, settled by the courts of the province of Quebec.

If the User is a consumer under the Quebec Consumer Protection Act, then any litigation will be ruled by the law of the Province of Quebec and the competent jurisdiction will be determined according to the rules of the Code of Civil Procedure.

INTERPRETATION

This Policy is governed by applicable Quebec and Canadian laws, including the Privacy Act of Canada. These laws apply without giving effect to any conflict of law principles.

Whenever the context so requires, any word written in the singular also includes the plural and vice versa; any word written in the masculine gender also includes the feminine gender and vice versa.

DIVISIBILITY

Each provision of this Policy forms a separate whole so that any determination by a court that any provision of the Policy is void or unenforceable shall not affect the validity or enforceability of any other provision of the Policy

AMENDMENT OF THIS POLICY

Immocalcul Inc. occasionally updates this Policy. Continued use of this Platform constitutes the User’s agreement to this Policy and to its updates.

However, when the Consumer Protection Act applies, Immocalcul Inc. will notify thirty (30) days prior to the coming into effect of the modification of the present Users of the Platform. If the User refuses these changes and wishes to no longer use the Platform, he will have no later than thirty (30) days following the entry into force of the amendments to send a notice to Immocalcul Inc.

Please read carefully the following Terms of Use (hereinafter ('Terms of Use') of Immocalcul Inc. a company whose registered office is located in the city of Laval, in the province of Quebec, Canada (hereinafter 'Immocalcul Inc.').

Immocalcul Inc. operates this website https://immocalcul.com/ and mobile application (hereinafter the 'Platform'). The Platform acts solely as an intermediary between Users and financial product providers (hereinafter the 'Provider' or 'Providers'). The Platform offers a financial product comparison service, to allow users, understood as the end user or the organization you represent or for which you work (hereinafter the 'User' or the 'Users') to have access to information allowing them to compare rates and evaluate the advantages and disadvantages of financial products, including mortgage rates (hereinafter the 'Financial Products') to be able to select the Financial Products best suited to their needs.

By choosing to use the Platform and Immocalcul Inc. services, the User agrees to all the Terms of Use set forth below that govern the content and use of the Platform, as well as the Privacy Policy that follows the Immocalcul Inc. Terms of Use.

By using Immocalcul Inc. services, Users understand and acknowledge that the Platform only allows Users to obtain information and compare third-party Financial Products. Immocalcul Inc. is not a Provider, seller or broker of Financial Products, nor is it a financial advisor. The information provided on the Website is for informational purposes only and does not constitute and should not be construed as financial or any other type of advice

These Terms of Use shall be legally binding upon the User and Immocalcul Inc. (hereinafter the 'Parties'). The Parties shall be entitled to invoke these Terms of Use and to take any action necessary to enforce them.

If the User does not agree to these Terms of Use or, as the case may be, to the Terms of Use as amended, the User shall not, or shall no longer, use the Platform.

ACCESS AND USE OF THE PLATFORM.

If the User browses the Platform, it means that he has read, understood and accepted the Terms of Use.

The Platform is accessible from any computer tool (computer, smartphone, tablet, etc.) and on all browsers.

All web browsers normally allow an optimal use of the Platform.

The Platform is accessible on the Apple Store (with iOS system), on Google Play (with Android system), on Amazon app and on our website and from any computer tool (computer, smart phone, tablet, etc.).

THE SERVICE

The Platform is always accessible. The Platform may be temporarily unavailable in case of updates or technical problems. Immocalcul Inc. is not responsible for any interruption of service or updating. Immocalcul Inc. tries to make the updates when the affluence of visits on the Platform is at its lowest.

Immocalcul Inc. does not guarantee that the Platform, or any portion thereof, will function on any hardware or devices. In addition, the Platform may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.

Immocalcul Inc. reserves the right to add, remove and edit all or part of the content on the Platform, except for User's own content. Immocalcul Inc. is not responsible for mistakes, typographical errors or bugs. Each User created in the system owns the content on his account. Immocalcul Inc. does not delete anything unless a User requests it.

The User agrees, non-restrictively, to not:

  • Use the Platform in a way that could harm, put out of service, surcharge or jeopardize the Platform;
  • Disrupt the security or otherwise abuse the Platform or any service, system’s resources, server or network linked to the Platform as well as affiliated websites, linked to or accessible from the Platform;
  •  Disrupt or interfere with the use or enjoyment of the Platform by other services or affiliated or linked sites;
  • Upload, display or otherwise provide on the Platform a virus or any other file or computer program that is harmful, disrupting or destructive;
  • Use a robot, spider or other automatic device or manual process to monitor or copy the Platform's pages or content;
  • Use the Platform to send e-mail chains, «junk mail» or any other type of unsolicited mass e-mail;
  • Attempt to gain unauthorized access to the Platform or portions thereof to which access is restricted. Further, User agrees that it is solely responsible for all actions and communications undertaken or transmitted to or on behalf of User, and agrees to comply with all applicable laws with respect to its use or activities on the Platform;
  • Download the application on a computer and try to decompress it.

INTELLECTUAL PROPERTY

Unless otherwise specified, all intellectual property rights (trademarks, copyrights, etc.) (hereinafter the “Intellectual Property”) related to the Platform are the exclusive property of Immocalcul Inc. The User may not copy or use the material, structure, menu, appearance or characters that appear on the Platform without the express consent of Immocalcul Inc.

Certain names, words, titles, expressions, logos, icons, graphs, drawings, domain names or other content displayed on the Platform may, among other things, be trademarks or commercial designations, whether registered or unregistered (for the purpose of the following Terms of Use, they are all referred to as “Trademarks”). These Trademarks are protected by Canadian and foreign laws applicable to trademarks and are, as the case may be, the exclusive property of Immocalcul Inc.

Without limiting their coverage, the Intellectual Property elements belonging to Immocalcul Inc. include, non-exhaustively, the following elements:

  • All logos, drawings, graphs, marks (registered or not), symbols, texts, expressions, words as well as the general content on the Platform;
  • All software, APIs and materials made available by the Platform;
  • All databases made available by the Platform; and
  • All the content offered by the Platform for free download.

Any information provided on the Platform belongs to Immocalcul Inc. and is protected by the applicable laws. Unless otherwise indicated, the information cannot be copied, displayed, distributed, downloaded, used without a license, modified, published, reproduced, reused, sold, transmitted or used for derivative work means, public or commercial, without Immocalcul Inc.’s express and written authorization. The information is protected under Canada’s copyright and trademark legislation as well as under the copyright and trademark legislation of the countries hosting the Platform.

Images and text contained on the Platform that are downloaded, copied, saved or printed are still subject to these Terms of Use. You must ensure that all copyright and trademark notices are still included. The content of the Platform may be changed at any time without notice. For further information regarding the authorization to use, reproduce or publish again any information displayed on the Platform, please contact Immocalcul Inc. at the following e-mail address: [email protected].

Nothing contained herein shall be interpreted as conferring any license or any kind of right to the User under copyright or trademarks laws.

Unauthorized download, broadcast, copy or modification of Intellectual Property or data contained in the Platform can breach laws regarding trademarks or copyrights. Such breach can expose the User to a lawsuit.

Subject to applicable laws, the import, creation, submission or storage of content by the User grants Immocalcul Inc. a non-exclusive license worldwide, free of charge, transferable, and sub-licensable. This license authorizes Immocalcul Inc. to host, use, modify, reproduce, publish, publicly perform, create derivative works, or distribute the User’s content. Under this license, Immocalcul Inc. may only use the User’s content for the purpose of operating, promoting or improving its services. If the User wish to terminate this license, he simply has to delete his account. However, the content the User has shared will always be visible to other Users: you can request its removal, with some reservations, from the contact person, who you can contact at: [email protected].

EXTERNAL LINKS

It is possible that by using a link, the User exits the Platform to access external content (hereinafter referred to as “External Links”). In addition to its own content, Immocalcul Inc. provides on its Platform links to other websites only for user-friendly and informative purposes. Immocalcul Inc. has no control over the content of those websites and is not responsible for their accuracy, precision, comprehensiveness, authenticity, actuality or adequacy.

Immocalcul Inc. is also not responsible for any direct or indirect damage or consequence regarding content in these External Links. The following conditions are applicable when the User accesses a social media page, an account, a website, network or any application contained in them that was created and is managed by a social media (hereinafter individually and collectively referred to as “Social Media”).

General statement: By using Social Media pages and by submitting a comment, a picture, a video or any other element, the User (as well as his parent/legal guardian if he has not reached the age of majority according to his territory or province of residence) agrees to be bound by and to obey the present Terms of Use, Immocalcul Inc.’s privacy policy as well as Social Media providers’ terms and conditions, if any. The User agrees, however, that Immocalcul Inc. may copy, edit, publish, translate and distribute the User’s comments, photos, videos or any other element published on a Social Media, and this without any counterpart.

Social Media Terms of Use: Some comments and other elements displayed on Social Media pages may not represent Immocalcul Inc.’s opinions. Consequently, the User agrees not to publish or submit information, publications, links or any other element that fit in either one of the categories listed below on Social Media pages: Any content whose nature is defamatory, offensive, obscene, misleading, illegal or that otherwise violates the rights of others (including privacy rights) in any other way; Any advertising content; Any promotional documents or other form of undesired solicitation;

Any information, message, link or item that, according to Immocalcul Inc., enters in either one of the categories listed above will be deleted without holding Immocalcul Inc. liable in any way.

In addition, Immocalcul Inc. does not assume responsibility for filtering messages posted on Social Media

Immocalcul Inc. is not liable for entities detaining or exploiting Social Media, particularly for any loss, direct or indirect damage deriving from any measure or decision taken by the User or anyone else regarding the use of Social Media

DISCLAIMER, EXCLUSION OF WARRANTY AND INDEMNITY

Immocalcul Inc. does not guarantee the accuracy, completeness, quality, suitability or content of the information on its Platform. This information is provided 'as is', without warranty or condition of any kind, unless otherwise stated in jurisdictions that do not allow the exclusion of implied warranties.

Immocalcul Inc. is not responsible for the content posted on the Platform by Users and for any damage that may result from it. Each User is responsible for the content he exchanges on the Platform and may not use the Platform for purposes contrary to the laws applicable in Quebec and Canada.

Except where the Consumer Protection Act is applicable, Immocalcul Inc. shall not be liable for any direct, indirect, special, incidental or consequential damages, or any other damages whatsoever, including loss of income, profits or anticipated economic benefits from the use or inability to use the Platform, the information, documents and software contained therein, with their content, even if Immocalcul Inc. has been warned of the possibility of such damages or even if such damages may be reasonably foreseen.

The User will indemnify Immocalcul Inc., and, as the case may be, its directors and officers, shareholders, partners, employees, agents and other stakeholders of Immocalcul Inc., and release them from all liability for any and all claims, liabilities, losses and fees (including legal fees) attributable to the use of the Platform and/or the violation of these Terms of Use, whether this infringement is on the User’s behalf or any other third-party user of his account

The User may not use or export the information nor any copy or adaptation of the information in contravention of applicable laws or regulations.

Certain information and data accessible on the Platform comes from external sources, including governmental, municipal, public or private organizations and third-party data providers. Immocalcul Inc. does not necessarily create such data and has no control over its accuracy, completeness, timeliness or availability.

Despite reasonable efforts to present reliable and up-to-date information, Immocalcul Inc. does not guarantee that the data displayed is free from errors, omissions, update delays or inaccuracies. The User remains responsible for verifying any information with the appropriate official source before making any decision, including any real estate, financial, legal or environmental decision.

AMENDMENTS TO THESE TERMS

We occasionally update these Terms of Use. Continued use of this Platform constitutes the User’s agreement to these Terms of Use and to its updates.

However, when the Consumer Protection Act applies, Immocalcul Inc. will notify, thirty (30) days prior to the coming into effect of the modification of the present, Users of the Platform. If the User refuses these changes and wishes to no longer use the Platform, he will have no later than thirty (30) days following the entry into force of the amendments to send a notice to Immocalcul Inc.

Any information, message, link or item that Immocalcul Inc. considers to fall within one of the categories listed above will be removed immediately, without any liability to Immocalcul Inc.

Furthermore, Immocalcul Inc. assumes no responsibility for filtering messages posted on Social Media.

Immocalcul Inc. disclaims all liability with respect to entities that own or operate Social Media, including for any direct or indirect loss or damage arising from any action or decision taken by the User or by another person in connection with the use of Social Media websites.

INTERPRETATION

The headings in the preceding sections are inserted for reference purposes only and shall not affect the construction or interpretation of the provisions of these Terms of Use.

Wherever the context requires, words importing the singular number shall include the plural and vice versa; words importing the masculine gender shall include the feminine gender and vice versa.

Where the User is a consumer within the meaning of the Quebec Consumer Protection Act, the Act does not permit the exclusion of warranties or the limitation of Immocalcul Inc.'s liability for certain damages. In such cases, the User has additional rights and is not subject to certain limitations set out below.

Except where the Consumer Protection Act applies, Immocalcul Inc. shall not be liable for any direct, indirect, special, incidental or consequential damages, or any other damages whatsoever, including loss of income, profits or anticipated economic benefits arising from the use of or inability to use the Platform, the information, documents and software contained therein and their content, even if Immocalcul Inc. has been advised of the possibility of such damages or even if such damages could reasonably have been foreseen.

The User shall indemnify Immocalcul Inc. and, where applicable, its directors, officers, shareholders, partners, employees, agents, consultants and other representatives of Immocalcul Inc., and shall release them from all liability for any claims, liabilities, losses and expenses (including legal fees) attributable to the use of the Platform and/or the violation of these Terms of Use, whether such violation is committed by the User or by any third-party user of the User's account. The User may not use or export the information, or any copy or adaptation of the information, in violation of applicable laws or regulations.
